General Terms And Conditions
INSURANCE
Travel Insurance
Customers are responsible for their own Travel Insurance, relative to medical costs, personal accident, and personal loss. Lost Beach Tours & Transportation S.R.L will not be liable if anyone should fail to take an adequate Travel Insurance cover prior to departure from the country of domicile. During transportation, all customers in the vehicles of Lost Beach Tours & Transportation S.R.L are properly insured under the local transportation insurance policies. (Some Travel Insurance is included on certain Credit Cards so it’s worth checking to see if you’re already covered by your Credit Card.)
Third parties
Lost Beach Tours & Transportation S.R.L is not responsible for the insurance of third party operators which are being sold through Lost Beach Vacations SRL. All customers which have booked a tour/activity through Lost Beach Tours & Transportation S.R.L will join at their own risk. If an accident of any kind may occur, the Local Jurisdiction (Costa Rica) will be applied to during a possible case.
LIABILITY CLAUSE
All Tours, Activities and Transportation services undertaken by customers are of their own choice and at their own risk. These include activities such as zip lining, scuba diving, rappelling, hiking and all other water, beach and outdoor related sports during the Tour/activity Services. Lost Beach Tours & Transportation S.R.L or the rental properties can’t be held responsible for any personal accidents which may occur during the above-stated activities.
Lost Beach Tours & Transportation S.R.L will request any customer partaking in the Tours, Activities and Transportation services offered by Lost Beach Tours & Transportation S.R.L to fill out a Waiver (Liability Release Form).
RESPONSIBILITY CLAUSE
Luggage
Lost Beach Tours & Transportation S.R.L is not responsible for the loss or damage to equipment and personal belongings due to the customer’s own actions. Lost Beach Tours & Transportation S.R.L will not be held responsible for loss or damage to equipment and personal belongings due to circumstances beyond our control, such as rainy weather, swimming with non-water proof devices, damage to equipment by sand or stones. Under no circumstances is Lost Beach Tours & Transportation S.R.L to be construed as a carrier under contract for safe carriage of his or her luggage and belongings. Luggage and belongings are carried at customer’s own risk, these being advised to closely watch the possible loading and unloading of their belongings.
Rental equipment
Lost Beach Tours & Transportation S.R.L has the authority to claim the cost of repair for any damages caused by the customer to the rented equipment such as snorkel gear and inflatable devices.
Behavior
Any customer that, in the opinion of the tour/activity organizers or crew of Lost Beach Vacations SRL, presents a danger to himself or herself or to others may be asked to leave the tour/activity. No customer will be asked to leave the tour/activity without cause, however, nor without receiving reasonable opportunity to comply with safe and responsible behavior. Anyone under the age of 16 must be accompanied by a responsible adult. There is no refund for anyone removed from the tour/activity. When removal occurred, transportation to the hotel is at the customer’s own cost.
Medical responsibility
Good physical- and mental health are essential for the enjoyment of the Tour/activity Services. All customers have to come in good condition. It is essential that any customer with a medical condition requiring regular treatment or which may be affected by vigorous activity, high altitude, heat, cold, other natural phenomena, or foods, notify Lost Beach Vacations SRL, in advance of the tour/activity. All customers must carry their own medical insurance, valid for the duration of the tour/activity.
Customers Requiring Special Assistance
Any disability requiring special attention should be reported at the time the reservation is made. Lost Beach Tours & Transportation S.R.L will make reasonable attempts to accommodate the special needs of such customers, but it is not responsible for any denial. Lost Beach Tours & Transportation S.R.L regrets that it cannot provide individual assistance to a tour/activity customer for walking, swimming or other personal needs. Customers who need such assistance must be accompanied by a qualified companion.
CANCELLATIONS AND REFUNDS
Deposits
For administrative and operational reasons, no refund can be given on a deposit when tours/activities are cancelled by the customer. In the case of NO SHOW, due to the customers’ own responsibility, no amount, deposit or full payment will be refunded.
Payments in full
– If the customer finds it necessary to cancel his/her reservation more than 7 days, prior to tour/activity departure, Lost Beach Tours & Transportation S.R.L will retain 10% of the payment.
– If the customer finds it necessary to cancel his/her reservation within 2 – 7 days, prior to tour/activity departure, Lost Beach Tours & Transportation S.R.L will retain 50% of the payment.
– If the customer finds it necessary to cancel his/her reservation within 48 hours, prior to tour/activity departure, Lost Beach Tours & Transportation S.R.L will retain 100% of the payment.
All requests for refunds will be considered promptly.
Cancellations by company
Lost Beach Tours & Transportation S.R.L reserves the right to cancel the tour/activity because of insufficient registrations or unforeseeable circumstances. All payments will then be refunded and/or suggestions for other comparable tours/activities will be given. Payments (Deposits and/or amounts in full) must be received or signed for (room booking/bill) at the location of reservation at least 48 hours prior to tour/activity departure. All payments must be in the form of U.S. dollars or Costa Rican Colones.
If payment or signature of approval (room booking/bill) is not received when due (48 hours prior to tour/activity departure), Lost Beach Tours & Transportation S.R.L reserves the right to treat the reservation as cancelled. If for any reason a customer is removed from the tour/activity, he or she will not receive a refund of the used services as stated above in the responsibility clause section.
TOUR/ACTIVITY MODIFICATION
Lost Beach Tours & Transportation S.R.L designs its tour/activities with a degree of flexibility, to provide you with the best possible opportunity for exploring Cost Rica. However, circumstances may arise which would require an adjustment to the tour/activity due to weather, availability of routes, problems with old routes, etc. Lost Beach Tours & Transportation S.R.L will do all that is possible to avoid such changes, but it must reserve the right to make such modifications if they are determined to be necessary.
WEATHER POLICY
All of our tours will run rain or shine. When it rains here it is still relatively warm and the rain can actually enhance your experience while you are in the rain forest during the rain. However, if the rain is so strong that it creates conditions that your guide deems it unsafe, we will cancel the tour and you can reschedule or receive a refund.
PRICES & VOUCHERS
Prices
Lost Beach Tours & Transportation S.R.L reserves the right to change the prices of the tour/activity without official notification. All prices are in US dollars ($) or Costa Rica Colones (₡). Dollar rate Lost Beach Vacations SLR.: 1 US dollar = currency rate of the specific day
If applicable the following age categories apply:
Children: 4 – 12 years of age.
Adults: above 12 years of age.
Vouchers
Only customers with a valid voucher purchased or received at an official reservation or distribution desk are allowed to make use of the tour/activity offering of Lost Beach Vacations SRL.
GENERAL
Smoking is prohibited in all vehicles.
Beverages of any kind are prohibited in the transportation vehicles.
Littering the surroundings will not be tolerated and can lead to immediate termination of the tour/activity!
Gratuities: Tips are not required or included in the tour/activity price because Lost Beach Tours & Transportation S.R.L believes they should be entirely a matter of personal discretion on the part of our customers.
